Terms of Service

1. Definitions

"Platform" means the Quest2Offer website, desktop application, API, and all related services operated by Quest2Offer.

"User" or "You" means any individual who accesses or uses the Platform.

"Content" means any text, data, files, or materials uploaded, submitted, or generated through the Platform.

"Service" means all features and functionality provided by the Platform, including but not limited to AI-powered career consulting, course generation, interview preparation, real-time transcription, and translation.

2. Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms of Service, our Privacy Policy, and our Acceptable Use Policy. If you do not agree to any of these terms, you must not use the Platform.

We reserve the right to modify these Terms at any time. Continued use of the Platform after modifications constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

3. Account Registration

To use the Platform, you must authenticate via Google OAuth. You are responsible for maintaining the security of your account credentials. You represent that all information you provide is accurate and complete.

You may not share your account with others, create multiple accounts, or use the account of another person. We may suspend or terminate accounts at our sole discretion.

4. Subscription Plans and Billing

The Platform offers paid subscription plans. By subscribing, you agree to pay all applicable fees as described on the pricing page at the time of purchase.

The Platform supports two payment methods:

Subscriptions are billed in advance for the selected period. Fees are non-refundable except as expressly stated in Section 5.

We reserve the right to change pricing at any time. Price changes will not affect active subscription periods already paid for.

5. Refund Policy

You may request a refund by contacting us at quest2offer@gmail.com within fourteen (14) calendar days from the date of purchase. Refund requests will be reviewed on a case-by-case basis at our sole discretion.

We reserve the right to deny refund requests if we determine that the Service has been substantially used, abused, or if the request is fraudulent. Approved refunds will be processed within fourteen (14) business days.

No refunds will be issued after the 14-day review period, for any reason, including but not limited to dissatisfaction with results, change of mind, or failure to use the Service.

For card payments processed through LemonSqueezy (our Merchant of Record), refund processing is additionally subject to LemonSqueezy's refund policies and procedures. The decision on refund eligibility remains at our sole discretion.

6. AI-Generated Content Disclaimer

THE PLATFORM USES ARTIFICIAL INTELLIGENCE TO GENERATE CONTENT, INCLUDING BUT NOT LIMITED TO CAREER ADVICE, COURSES, QUESTS, INTERVIEW PREPARATION MATERIALS, TRANSCRIPTIONS, AND TRANSLATIONS. SUCH CONTENT IS PROVIDED "AS IS" AND WITHOUT ANY WARRANTY OF ACCURACY, COMPLETENESS, OR FITNESS FOR ANY PARTICULAR PURPOSE.

AI SYSTEMS FREQUENTLY PRODUCE ERRORS, HALLUCINATIONS, AND INACCURATE INFORMATION. YOU MUST NOT RELY ON AI-GENERATED OUTPUT WITHOUT INDEPENDENT VERIFICATION. THE PLATFORM DOES NOT GUARANTEE THE CORRECTNESS OF ANY AI-GENERATED CONTENT.

AI-generated content does not constitute professional career advice, legal advice, educational certification, or any form of professional counsel. You should independently verify all information and consult qualified professionals before making any career, educational, or financial decisions based on Platform output.

Real-time transcription and translation features are approximate and may contain errors, omissions, or mistranslations. These outputs are not suitable for legal, medical, regulatory, or any other official use.

We make no guarantees regarding employment outcomes, interview success, salary changes, or career advancement resulting from use of the Platform.

7. Service Availability

The Platform is provided on an "as available" basis. We do not guarantee any specific level of uptime, availability, or performance, and we do not offer any Service Level Agreement (SLA).

We reserve the right to modify, suspend, or discontinue any feature or functionality of the Platform at any time, with or without notice, and without liability to you.

The Platform may be temporarily unavailable due to maintenance, updates, server failures, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUEST2OFFER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM EXCEED THE TOTAL AMOUNT OF FEES ACTUALLY PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Quest2Offer and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any Content you submit to the Platform.

10. Intellectual Property

The Platform, including its design, code, features, and branding, is the exclusive property of Quest2Offer and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform without our prior written consent.

You retain ownership of any personal data, resumes, and materials you upload to the Platform. By uploading Content, you grant us a limited, non-exclusive license to process such Content solely for the purpose of providing the Service.

11. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately.

You may terminate your account at any time by contacting support. Termination does not entitle you to a refund of any fees already paid, except as provided in Section 5.

Sections 6, 7, 8, 9, 10, and 12 survive termination of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Quest2Offer operates, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, unless prohibited by applicable law. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Quest2Offer regarding your use of the Platform and supersede all prior agreements and understandings.
